Microsoft, Intel partner on educational discount programme

Clearly spooked by the success of the low-cost Linux-based Raspberry Pi, Microsoft and Intel have teamed up with RM to launch the Shape the Future UK programme.

Microsoft, Intel and RM Education have announced the Shape the Future UK programme through which they aim to promote UK computing education.

Announced today, the programme sees the three companies partner up to provide hardware and software at a hefty discount - over 30 per cent, it's claimed - to all government-funded schools across the UK. Those signing up to the scheme will provide one-to-one access to computing resources for their pupils - meaning everybody gets a tablet or laptop of their very own.

It's claimed that the programme came about due to research from credit reference agency Experian suggesting that access to a home computer can have a significant impact on future earnings potential. According to the Impact of 1:1 PC Ownership report, based on research data from PriceWaterhouseCoopers, children who have access to a computer at home could generate up to ?300,000 more earnings over their lifetime than those that don't.

There is, of course, another, unmentioned, reason for Microsoft and Intel to show a sudden interest in the education market: the Raspberry Pi. The ?30 device, which provides a fully-functional microcomputer in a credit-card sized package, is proving a big hit and has no lesser aims than conquering the education market. If that happens, both Intel and Microsoft stand to lose: the Raspberry Pi uses an ARM-based processor from Broadcom rather than an Intel x86 chip, and typically runs a Linux operating system rather than Microsoft's Windows.

The idea of future generations of engineers and programmers growing up in a non-Wintel environment is clearly unconscionable to Microsoft and Intel, leading inexorably to the birth of the Shape the Future UK programme.

'Shape the Future has the power to put knowledge in the hands of children. That knowledge empowers them to shape their own future,' claimed Microsoft's Joice Fernandes, leader of the worldwide Shape the Future programme, at the announcement. 'I passionately believe that Shape the Future is a true force for good - as has been proven with our projects around the world. I'm thrilled that we are now bringing this programme to the UK.'

'Technology in Education is moving into a new era of mobility and usage, with more and more students continuing their learning beyond the classroom, especially at home. We at Intel are very excited about this program and that we feel it will help bridge the accessibility of technology to all students, with a scheme that is all encompassing and fair,' added Tim Hatch, Intel's director for UK education. 'We need our students from whatever their backgrounds to have that equal start in life and help them become the next generation of informed, flexible and collaborative employees.'

Danville will host regional conference on using fiber to shape growth ...

Leaders in all areas of the advanced broadband industry will gather Thursday and Friday in Danville to share their expertise on how to use fiber networks a catalyst for economic development.

The conference, which will be held at the Institute for Advanced Learning and Research, will draw nearly 250 industry executives and professionals and local and state government officials from Virginia, North Carolina, Maryland, West Virginia, South Carolina and beyond.

The Danville conference is the first in a series arranged in response to growing interest on the part of communities in obtaining their own fiber networks ? as Danville has done. The series is planned by Broadband Communities, which is a national trade magazine that serves as a leading source of information on digital and broadband technologies for communities. Broadband Communities selected Danville to serve as host for its first conference because of the city?s success in building a fiber network and using it to attract businesses and individuals seeking advanced telecommunication services.

?We are working on all fronts to bring positive attention to Danville,? City Manager Joe King said. ?As the host, this conference will be another opportunity for us.?

Mayor Sherman Saunders, King and city staff will lead off the conference on Thursday with a presentation on ?The Danville Story.? The story will share information on the benefits of a fiber network for municipalities, and it will detail how nDanville and the regional fiber network enable economic development. This fiber network was essential, for example, in bringing the Cray XMT2 supercomputer to Danville.

Ted Sojourner, regional vice president for Essel Propack in Danville, Dr. Chris Payne, a dentist with Danville Dental Associates, and Dr. Frank Maddux, the founder and a principal shareholder of Gamewood Technology Group of Danville, will relate their experiences in using the fiber network.

Tad Deriso, president and chief executive of the Mid-Atlantic Broadband Cooperative in Virginia, also will make a presentation.

In total, the conference will feature 40 speakers.

Jim Baller, president of the Baller Herbst Law Group, will serve as program chair for the conference. Baller Herbst is a national law firm that specializes in communications and related matters, and Baller is recognized as the nation?s most experienced and knowledgeable attorney on public broadband matters.

Earlier this year, Danville received national attention when King served as a presenter at a fiber technology summit held in Dallas and hosted by Broadband Communities. Summit organizers held up Danville as a model for how small cities can use a fiber network.

The summit attracted nearly 1,000 participants, including broadband system operators, network builders and deployers, major property owners and real estate developers, independent telecommunication and cable companies, municipal and state officials, community leaders and economic developers.

Danville?s high-speed fiber network operates under the name of ?nDanville.? Danville builds and maintains the network, and then allows private businesses to travel and sell services over it. In contrast to networks operated by many cities, nDanville does not compete directly with cable and telephone companies as a retailer for Internet, television and telephone services. These services must be supplied by separate retail providers.

NDanville serves all of the Danville municipal and utility facilities, 27 schools and 93 businesses. NDanville connects local businesses to northern and eastern Virginia, the North Carolina Research Triangle, and points beyond over the Mid-Atlantic Broadband Cooperative?s regional fiber network.

NDanville?s first phase of fiber-to-the-home deployment to 400 houses in central Danville is under way. The fiber network is self-sufficient financially, operating on fees charged to its users. It will expand on a pay-as-you-go basis and carries no debt.

Obama, Romney Campaign Intensely In 2012 Swing States

DUBUQUE, Iowa, Nov 3 (Reuters) - The U.S. presidential race, which has hinged for months on a handful of states, converged on one city in Iowa on Saturday as President Barack Obama and Republican Mitt Romney each made a last-minute appeal for support before Tuesday's election.
With the race in a dead heat nationally, both candidates touched down briefly in Dubuque, a Mississippi River city of 58,000 people, as they sprinted across the country in a bid to secure any possible advantage before Election Day.
In an airport rally early in the afternoon, Romney urged supporters to try to sway friends and neighbors who back Obama. He said he would reach out to Democrats as well if elected - a stance that could appeal to independent voters who have little stomach for partisan gridlock.
"I want you to reach across the street to the neighbor, who has that other sign in his front yard. And I'm going to reach across the aisle in Washington, D.C., to the politicians who are working for the other candidate," Romney told about 2,000 people.
Six hours later, Obama reminded about 5,000 people in a park in downtown Dubuque that he had started his first presidential bid in Iowa in 2007, and highlighted successes of his time in office, such as ending the war in Iraq and expanding access to healthcare.
"After two years of campaigning and after four years as president, you know me by now. You may not agree with every decision I made, you may have sometimes been frustrated with the pace of change. But you know that I say what I mean and I mean what I say," Obama said.
A new poll by the Des Moines Register newspaper showed Obama leading Romney by 47 percent to 42 percent in Iowa, though the survey showed the president barely edging his opponent on the critical question of which candidate would do better fixing the economy.
Earlier in the day in Ohio, Obama hammered Romney for opposing his bailout of the auto industry and said his challenger tried to scare workers by saying inaccurately that Chrysler planned to shift jobs to China.
About one in eight Ohio jobs is tied to auto manufacturing, and the bailout has helped Obama win over some of the white working-class voters who are heavily backing Romney in rest of the country.
"I've been a Republican for 35 years and I've never voted for a Democrat on the federal level - until now," retiree Patrick Dorsey said as he waited for Obama to speak. "Economically, Romney's just going to make the rich richer."

TIGHT RACE IN POLLS
Romney will have a hard time winning the White House if he does not carry Ohio, and a Reuters/Ipsos poll released on Saturday showed him trailing Obama by a statistically meaningless margin of 1 percentage point in the state. Other polls show him trailing by a larger margin in Ohio.
The race for the White House remains effectively tied at a national level, with 47 percent backing Obama and 46 percent supporting Romney, according to a Reuters/Ipsos daily tracking poll released on Saturday.
Still, analysts say Obama holds an edge in many of the eight or nine competitive states that will determine who controls the White House. Reuters/Ipsos polls released on Saturday showed Obama leading by 3 percentage points in Virginia but trailing by 2 points in Colorado. The two were dead even in Florida. All the results were within the credibility interval, a measurement of the accuracy of online polls.
Other surveys generally show Obama leading by narrow margins in Wisconsin, Nevada and New Hampshire. Romney is considered to have the edge in North Carolina.
Romney has tried to expand the battlefield over the past week to states that had been considered beyond his reach.
"We win Pennsylvania, we save America in three days," Romney's vice presidential running mate, Paul Ryan, said at an airport rally in the state capital, Harrisburg.
Ryan is due to visit Minnesota on Sunday, another state that has been considered solidly Democratic. Romney himself is due to speak in Pennsylvania on Sunday.
Obama officials say the Romney campaign is visiting those states out of desperation because he has been unable to establish a clear lead in other battleground states.
Nevertheless, the Obama campaign is dispatching Vice President Joe Biden's wife, Jill Biden, to Pennsylvania and former President Bill Clinton to Minnesota.
Capping Saturday's tour , Obama made a joint appearance with Clinton before an enthusiastic crowd of 24,000 - one of the largest of his campaign - at an outdoor arena in Bristow, Virginia. The Dave Matthews Band provided the warm-up act.
On stage, Clinton mocked Romney for his shifting positions and attempts to explain away earlier comments on the auto bailout, saying the Republican "tied himself in so many knots ... that he could be hired as the chief contortionist for the Cirque du Soleil."
Clinton, seen by Obama's campaign as appealing to undecided voters because of the prosperous economy he presided over, lauded the president as a "good commander-in-chief and a good decider-in-chief."
Earlier on Saturday, Obama also held a rally in Wisconsin, a state considered safely in his column earlier this year.
"You don't take anything for granted, you go as hard as you can to the end, and that's exactly what we're going to do in all our battleground states," said campaign manager Jim Messina.
Obama started the day at the federal government's disaster-relief headquarters in Washington, where he received an update on the efforts to help Northeastern coastal states recover from devastating storm Sandy.
The storm has afforded the Democrat an opportunity to rise above the fray of campaigning. But it has also raised the stakes for him to show his administration can respond quickly and effectively in a crisis, as residents of New York and New Jersey vent frustration at power outages and gasoline shortages.

Activist group: At least 50 troops killed in Syria

BEIRUT (AP) ? A Syrian activist group says a suicide car bomber has killed more than 50 Syrian soldiers and pro-government gunmen.

The Britain-based Syrian Observatory for Human Rights says the attack in the village of Ziyara in the central province of Hama was carried out by Jabhat al-Nusra, an al-Qaida-inspired Islamic militant group.

The death toll could not be independently verified.

State-run news agency SANA said the blast occurred outside a state-run development agency. It said Monday's blast caused deaths but gave no figure.

The Observatory also reported that an air raid on the northern town of Harem killed at least 20 rebels. It said a rebel commander was seriously wounded in the raid.

Could computer hackers disrupt the US election? It?s happened in other countries.

Hackers have targeted elections in Mexico, Canada, Russia, and South Korea. Experts warn that it could happen in the US, causing temporary disruptions and perhaps delaying election results.

Already this year, Mexico and the Dominican Republic both fended off cyber attacks on their national elections by the hacktivist group Anonymous. In Canada in March, the National Democratic Party had its party elections disrupted. Cyber attacks in the past year have also hit national elections in Russia, Ukraine, and South Korea.

To be sure, such attacks do not necessarily translate to the US election system. For all its flaws, US states still rely primarily on voting systems that utilize paper ballots or other paper backup systems that can be recounted or audited to confirm votes. Yet the threat of even a temporary disruption or manipulation of electoral websites run by county and state officials if it affects perceptions of the vote outcome ? even if it did not affect the actual results ? remains a worry, cyber security experts warn.

Last year a video appeared on YouTube claiming that Anonymous would target this year's presidential primaries and possibly the election itself. While some quickly dubbed the video a hoax, cyber security professionals aren't immediately dismissing the threat.

"These [hacker] attacks on elections are becoming quite an epidemic actually," says Carlos Morales, vice president of Global Sales Engineering and Operations for Arbor Networks whose team worked with the Mexican Instituto Federal Electoral to soften the blow from attacking hacktivists.

During Mexico's federal election, hackers claiming to be part of the Anonymous online collective bombarded the Federal Electoral Institute (IFE) website that tallies votes with a distributed denial of service (DDoS) attack ? which shoots data from myriad computers to make it hard to block the attempt to clog the Internet pipes at the target site.

Not only that, faked images were planted that appeared to show vote tallies being manipulated. In the Dominican Republic, the hacktivist group Anonymous Dominicana threatened a DDoS attack on Junta Central Electoral, the central election authority to disrupt the vote count and cast doubt on the validity of the election.

In both cases, the hacktivists failed mainly because both nations took action ahead of the vote to put in place systems that could deal with the electronic bombardment.

"Attacked, yes, damaged or disabled, not at all," said Ren? Miranda, IFE?s chief information officer, as reported in a Mexican cyber security magazine.

One wildcard in the US, however, that could be directly affected by DDoS style attacks ? the simplest, cheapest, and most anonymous kind of attack ? is the rise of Internet-based voting. At present, some 32 states make online voting available to some 3 million registered voters, including military personnel and citizens abroad, according to the Carlsbad, Calif.-based group Verified Voting, which tracks voting technology.

?At Dirt Candy, I don?t care about your health, your politics, or whether you?re a vegetarian or not ? I just want to make vegetables taste great,? explains Cohen.??The restaurant is like a lab and every day I?m experimenting to see what I can do with vegetables that hasn?t been done before.? ?

As the first vegetarian chef to compete on Iron Chef, Cohen believes things are constantly looking up for the meatless.?

?People have been conditioned to be disappointed by a lot of vegetarian food?and I think that?s partly our own fault. We?ve been content to serve a captive audience and not engage with the mainstream food world. But I think it?s time for us to step up our game. We have to try harder. Vegetarian food needs to become less about what we can?t eat ? meat ? and more about what we can eat ? everything else.?

5h ago - As of October 26, 2012 the Library of Congress has rejected a proposed exemption that would allow for the JailBreaking of video game consoles including the PlayStation 3, ruling that PS3 JailBreaking is to be considered illegal under the Digital Millennium Copyright Act (DMCA).

Because the Register determined that the evidentiary record failed to support a finding that the inability to circumvent access controls on video game consoles has, or over the course of the next three years likely would have, a substantial adverse impact on the ability to make noninfringing uses, the Register declined to recommend the proposed class.

Below are the details, to quote: "B. Video game consoles - software interoperability

Because the Register determined that the evidentiary record failed to support a finding that the inability to circumvent access controls on video game consoles has, or over the course of the next three years likely would have, a substantial adverse impact on the ability to make noninfringing uses, the Register declined to recommend the proposed class.

EFF, joined by Andrew "bunnie" Huang ("Huang" ), FSF, SaurikIT, LLC (SaurikIT), and numerous individual supporters, sought an exemption to permit the circumvention of access controls on video game console computer code so that the consoles could be used with non-vendor-approved software that is lawfully acquired.

EFF observed that modern video game consoles are increasingly sophisticated computing devices that are capable of running not only games but "entire computer operating systems." All three major video game manufacturers, however - Sony, Microsoft, and Nintendo - have deployed technological restrictions that force console purchasers to limit their operating systems and software exclusively to vendor-approved offerings. These restrictions require a console owner who would like to install a computer operating system or run a "homebrew" (i.e., independently developed) application to defeat a number of technical measures before they can do so - a process that proponents refer to as "jailbreaking." Proponents sought an exemption they proposed would enable interoperability only with "lawfully obtained software programs," proponents asserted that the exemption would not authorize or foster infringing activities.

In its comments, EFF explained the circumvention process with reference to Sony's PlayStation 3 ("PS3" ). Sony's PS3 employs a series of technological protections so that the console can only install and run authenticated, encrypted code. One such measure is the encryption of the console's firmware, which restricts access to the console. The firmware must be authenticated by the console's "bootloader" software and decrypted before it can be used. Once the firmware has been authenticated and decrypted, it, in turn, authenticates applications before they can be installed or run on the PS3. EFF added that Microsoft's Xbox 360 and Nintendo's Wii employ similar authentication procedures as technological protection measures.

In further support of its requested exemption, EFF recounted that when Sony launched the PS3 in 2006, it included a software application called "OtherOS" that permitted users to install Linux and UNIX operating systems on their consoles. EFF provided examples of researchers who were able to use these earlier PS3 consoles in lieu of other computer systems to conduct various forms of scientific research, citing an Air Force project that made use of 1700 PS3s, as well as two academic projects employing clusters of PS3s to create high-performance computers. Some of these researchers chose to use clustered PS3s because they were less expensive than the available alternatives. In 2010, however, Sony issued a firmware update for the PS3 that removed the OtherOS functionality. PS3 users were not forced to upgrade, but the failure to adopt the upgrade precluded access to certain gameplay features and might make repair or replacement of the gaming system more difficult.

EFF further asserted that none of the three major console manufacturers currently allows the installation of independently developed applications on their consoles unless the developer may require the developer to license costly development tools. As a result, hobbyists and homebrew developers engage in circumvention to defeat technical restrictions in order to create and run games and other applications on the PS3, Wii, and Xbox consoles.

EFF noted over 450 independently created games and applications for Nintendo's Wii available on the homebrew site WiiBrew.org, as well as some 18 homebrew games and several nongaming applications developed for the PS3 - including a file backup program called "Multiman" and an application that transforms the PS3 into an FTP server - and a handful of other homebrew applications for other platforms and handheld gaming devices. EFF pointed out that there is no strong homebrew community for the Xbox360, attributing this phenomenon to a Microsoft development program that allows developers to publish games "with relative ease."

Proponents argued that manufacturers' technological restrictions on video game consoles not only constrain consumer choice but also inhibit scientific research and homebrew development activities. Pointing to the Register's determination in the last Section 1201 rulemaking that circumvention of technological measures on smartphones to enable interoperability with lawfully obtained applications was a permissible fair use, proponents urged that the same logic should apply here. According to proponents, the restrictions on video game consoles do not protect the value or integrity of copyrighted works but instead reflect a business decision to restrict the applications that users can run on their devices.

EFF explained that a "large community" of console jailbreakers currently exists for all three major video game consoles but noted that such jailbreakers face potential liability under Section 1201(a)(1). As evidence of this, EFF cited recent litigation pursued by Sony against an individual and others who developed a method for jailbreaking the PS3. EFF explained that in January 2010, George Hotz (also known by his online name "GeoHot" ) published a method for among other things, that the defendants had conspired to violate the DMCA.

Finally, a few supporters of EFF's proposal suggested potential scenarios in which a console might need to be jailbroken to effectuate a repair but did not provide any specific evidence of actual repair issues.

The proposal to permit circumvention of video game consoles was vigorously opposed by the Entertainment Software Association ("ESA" ), Sony Computer Entertainment America LLC ("SCEA" or "Sony" ), and Joint Creators. Opponents filed extensive comments in response to EFF's request.

ESA characterized video game consoles as "the center of an intellectual property ecosystem" which makes copyrighted content readily and legally accessible, stating that the entire system depends upon effective and secure access controls. ESA explained that there are at least two potential access controls at issue. To play an unauthorized application, the user must circumvent not only the encryption on the console's firmware, but also modify the firmware to defeat the authentication check access control. It added that once modified, the firmware will operate, but the access controls will be circumvented, effectively allowing the console to run unauthorized content.

SCEA's comments focused on its PS3 console (the dominant example addressed in EFF's proposal). SCEA confirmed that the technological restrictions controlling access to the PS3 protect both its firmware and the copyrighted video games that are developed for that system. As explained by SCEA, allowing circumvention of the PS3 access controls would mean that the basic security checks could be skipped and the firmware freely modified to bypass or eliminate the process by which the video games are authenticated for use on the console, thus making it "virtually certain that successful hackers, under the guise of the exemption, will create the tools games."

Throughout their comments, opponents stressed piracy as an overriding concern, noting that once a user circumvents a console's security measures - even for an ostensibly benign purpose - it becomes a vehicle for unauthorized content. In their view, EFF's attempt to limit the exemption to interoperability with lawful applications would make no difference in practice, because "all known methods for circumventing game console [technological protection measures] necessarily eliminate the measures' ability to preclude the play, reproduction and distribution of infringing content."

In support of their contentions regarding the link between circumvention and piracy, opponents provided documentation of console "hacking packages" that come bundled with applications to play pirated content. They further noted, again with supporting materials, that the homebrew channel installed with a popular Wii hacking package automatically includes applications that enable the console to play pirated content. They pointed out, with still further support in the record, that the "Multiman" backup system referenced by EFF as an example of a useful application enabled by jailbroken PS3s is used to decrypt and copy protected PS3 games so they can be illegally distributed. Other documentary evidence submitted by opponents showed that the PS3 FTP file server application described by EFF is used as a means to transfer illegal files. Opponents also furnished multiple examples of advertisements for console jailbreaking services that included (for an all-in price) a library of pirated games.

Opponents pointed to online forums and other sources that specifically referenced George Hotz's hack of the PS3 - described sympathetically by EFF in its proposal - as permitting users to play pirated games and content, and provided representative postings. The documentation evidenced a broadly shared perception in the gaming community that jailbreaking leads to piracy would negatively impact the development of new games.

Possibly referring to Hotz, SCEA elaborated on the hacking issue by commenting specifically on the events surrounding a 2010 breach of its PS3 system. In that case, hackers announced that they had successfully circumvented the technological measures on PS3 firmware, which was accomplished by exploiting vulnerabilities in Linux operating in the OtherOS environment. Although the hackers stated that they did not endorse or condone piracy, one hacker subsequently published PS3's encryption keys on the internet, which were quickly used to create jailbreak software to permit the use of illegally made games. Sony saw an immediate rise in the number of illegal copies but no increase in homebrew development, while sales of legitimate software "declined dramatically." As a result of the hack, Sony decided it had no choice but to discontinue OtherOS and issued a system upgrade that disabled OtherOS functionality for those who wished to maintain access to Sony's PlayStation network.

Mindful of the exemption established by the Librarian in the prior proceeding to permit jailbreaking of smartphones, opponents urged that video game consoles are not the equivalent of iPhones, asserting that the technological measures on game consoles legitimately protect the creation and dissemination of copyrighted works by discouraging pirated content and protecting creators' investment in new games. Opponents distinguished the development of a video game - a long and intensive process "akin to motion picture production" involving a team of developers that can cost tens of millions of dollars - from the relative ease and inexpensiveness of creating a smartphone application. According to opponents, the development of new video games would be significantly impaired without reliable technological protections to protect developers' investments.

homebrew programs, opponents observed that while EFF's request focused on the PS3, the homebrew community for that device is small, as evidenced by the fact that less than one-tenth of one percent of PS3 users (fewer than 2,000 in all) had made use of the PS3's OtherOS feature. In any event, they noted, there are over 4,000 devices on which Linux can be run without the need for circumvention, and homebrew games and applications can be played on a wide array of open platform devices. Opponents further observed that each of the three major video game console manufacturers has a program to support independent developers in creating and publishing compatible games.

Finally, opponents disputed proponents' suggestion that circumvention is necessary to repair broken game consoles, explaining that each console maker offers authorized repair services free of charge for consoles still under warranty for a nominal fee thereafter.

Although EFF sought to rely upon the Register's 2010 determination that modification of smartphone software to permit interoperability with non-vendor-approved applications was a fair use, the Register concluded that the fair use analysis for video consoles diverged from that in the smartphone context. Unlike in the case of smartphones, the record demonstrated that access controls on gaming consoles protect not only the console firmware, but the video games and applications that run on the console as well. The evidence showed that video games are far more difficult and complex to produce than smartphone applications, requiring teams of developers and potential investments in the millions of dollars. While the access controls at issue might serve to further manufacturers' business interests, they also protect highly valuable expressive works - many of which are created and owned by the manufacturers - in addition to console firmware itself.

On the other hand, circumventing console code to play games and other entertainment content (even if lawfully acquired) is not a transformative use, as the circumvented code is serving the same fundamental purpose as the unbroken code. While the second and third fair use factors did not greatly affect the analysis, on the significant question of market harm, the Register concluded that opponents had provided compelling evidence that circumvention of access controls to permit interoperability of video game consoles - regardless of purpose - had the effect of diminishing the value of, and impairing the market for, the affected code, because the compromised code could no longer serve as a secure platform for the development and distribution of legitimate content. The Register noted that instead of countering this evidence with a factual showing to prove opponents wrong, EFF merely asserted that its proposal would not permit infringing uses. The Register did not believe that this response satisfied proponents' obligation to address the "real-world impact" of their proposed exemption. Overall, the Register found that proponents had failed to fulfill their obligation to establish persuasively that fair use could serve as a basis for the exemption they sought.

The Register further found that even if proponents had satisfied their burden of establishing noninfringing uses, they nonetheless failed to demonstrate that video game console access controls have or are likely to have a substantial adverse impact on such uses. Proponents identified two broad categories of activities that were allegedly threatened by the prohibition on circumvention, scientific research and homebrew software development. With respect to scientific research, a small number of research projects involving only one type of gaming console, the PS3, suggested a de minimis impact, if any. This conclusion was reinforced by record evidence indicating that Sony had in fact cooperated with and been a supporter of marketplace.

Nor, according to the Register's analysis, did the record support a finding that Section 1201(a)(1) is having a substantial adverse impact on lawful homebrew activities. The most significant level of homebrew activity identified by EFF appears to have occurred in relation to the Wii, but the record was relatively sparse in relation to other gaming platforms. Concerning the use of video game consoles to operate Linux software generally, the record showed that only a very small percentage of PS3 users availed themselves of the (now discontinued) OtherOS option that permitted users to run Linux on their PS3s. At the same time, there are thousands of alternative devices that can be used to develop and run Linux-based video games and other applications. In addition, the record indicated that developers can and do take advantage of various manufacturer programs to pursue independent development activities.

Finally, as noted above, the Register determined that proponents offered no factual basis in support of their suggestion that users are having difficulty repairing their consoles as a result of Section 1201(a)(1). This appeared to be only a hypothetical concern, as proponents failed to document any actual instances of users seeking to make repairs.

The Register therefore concluded that proponents had failed to establish that the prohibition on circumvention, as applied to video game console code, is causing substantial adverse effects.

Turning to the statutory factors, the Register took issue with proponents' view that piracy was an irrelevant consideration because the exemption they sought was only to allow interoperability with "lawfully obtained applications." The Register explained that she could not ignore the record before her. Even if piracy were not the initial or intended purpose for circumvention, the record substantiated opponents' assessment that in the case of video games, console jailbreaking leads to a higher level of infringing activity, thus sharply distinguishing the case of video consoles from smartphones, where the record did not support the same finding. The evidence also suggested that the restriction limiting the proposed class to "lawfully obtained" applications - which the Register has found effective in other contexts - did not provide adequate assurance in this case. The Register noted that simply to suggest, as proponents had, that unlawful uses were outside the scope of the exemption and therefore of no concern was not a persuasive answer.

Finally, the Register agreed with proponents' assessment that the access controls protecting video game console code facilitate a business model, as many technological restrictions do. But the Register concluded that in the case of gaming platforms, that was not the sole purpose. Console access controls protect not only the integrity of the console code, but the copyrighted works that run on the consoles. In so doing, they provide important incentives to create video games and other content for consoles, and thus play a critical role in the development and dissemination of highly innovative copyrighted works.

NTIA supported the "innovative spirit epitomized by independent developers and researchers whose needs proponents contemplate in this class," but noted that the evidence in the record was insufficient to support the considerable breadth of the proposed class. NTIA asserted that the record was unclear with respect to the need for an exemption to enable software interoperability, and that there was compelling evidence of reasonable alternatives available for research purposes. NTIA was also "cognizant of the proposal's likely negative impact on the underlying business model that has enabled significant growth and innovation in the video game industry."

Although NTIA did not support the exemption as requested by proponents, it did support a limited exemption to allow videogame console owners to repair or replace hardware console and authorized replacement parts are no longer on the market." As explained above, however, the Register found that the record lacked any factual basis upon which to recommend the designation of even such a limited class."

Among these idiot rulings includes unlocking smartphones (which pretty much any handheld device is considered a "smartphone"), jailbreaking tablets, and ripping DVDs for home uses.

Adoptive Relationships 101

One of my favorite things about the open adoption of my son, Garrett is the amazing relationship that I have developed with his birth mother, Susan and her family. In the beginning, we didn?t start out envisioning that we would have much of a relationship, but truthfully, I?m so grateful for the concept of open adoption because from the moment she placed her wee babe in my arms I knew that she was family forever!

Mine isn?t an uncommon story in the realms of open adoption these days and while not every open adoption story is full of happy endings, the chances are sure increased by the very existence of the concept.

There are a few things I have learned from a decade-long adoptive relationship with a biological parent. These are some highlights:

  • Every side will have different time frames. Times of opening more and times of opening less. Think of it as two steps forward/one step back.
  • Begin with the end in mind. You will most likely have a relationship of some sort the rest of your life. Everything you do today will count in a tomorrow.
  • To nurture a relationship, you have to TRULY CARE and strive to find out about who that other person is and what their goals are.
  • Remember important days! Birthdays, Anniversaries, Graduation, Placement Day, Father?s Day and especially remember Mother?s Day!
  • Keep your promises! If something is bothering you, you have to speak up! No one is a mind-reader.
  • Boundaries: You MUST keep private information private! Be especially careful with social media!
  • Patience, Faith and Prayer for each other. Give the Lord time to do His work!
  • One of my favorite quotes is from author Russ Elkins, author of Open Adoption, Open Heart, and he sums it up perfectly:

    ?Before placement occurs, it?s really hard to know how you?ll feel, and it?s hard to know how everyone else involved will feel. After all, adoption is something unique you never experience anywhere else in life. Make it your goal to be open to the feelings of other people involved. Think about how you would feel if you were in their shoes and go from there. Above all, understand that the process is emotionally taxing for everyone, not just for you. When everyone considers everyone else, open adoption is one of the most beautiful things this world has to offer.?

    I am certainly a better person for having experienced the joy of my adoption journey. Thanks to open adoption, I truly believe that my son?s birth mother Susan would echo my sentiment. The same might not have been said of a closed adoption many years ago. Sometimes evolution is good!

Obama to use 'affirmative' message in closing campaign pitch

WASHINGTON (Reuters) - After three days of focusing on superstorm Sandy, President Barack Obama will return to the campaign trail on Thursday with a more "affirmative" message to win over undecided voters in the final days of the race for the White House.

With polls showing a tight contest between the Democratic incumbent and Republican challenger Mitt Romney before Tuesday's election, Obama will use trips to political battleground states to make a closing appeal for a second term.

That argument will touch on points he has made for months about the choice between competing Republican and Democratic visions, Obama advisers said, but it will put more weight on Obama's ideas for the future and could resurrect some of the hopeful themes that helped him win election in 2008.

"You're going to see him lift up ... the vision of what we're fighting for," senior campaign strategist David Axelrod said in an interview last week before the storm, adding the construction of Obama's "stump" speech would alter slightly in the final days.

"We'll still address what the choice is. You have to address the choice. But I think it'll tilt toward the affirmative, toward the future."

Obama was to have started his closing argument on Monday during a rally in Florida, but he skipped that event to return to Washington to help coordinate storm relief. The massive storm pummeled New York City and other parts of the U.S. Northeast.

The president has not given a traditional campaign speech since Saturday - an unusually long period this close to Election Day - but has remained in the public eye with daily remarks in Washington and a trip to New Jersey to survey storm damage.

Romney, who also canceled some political rallies because of the storm, limited his attacks on the president while campaigning on Wednesday in Florida.

Obama won the 2008 election using the themes of "hope" and "change," which resonated with voters disgruntled with the policies of Republican President George W. Bush.

This year, Obama used "Forward" as his slogan, but his message - and that of his surrogates - has included stinging attacks on Romney, a former private equity executive and Massachusetts governor.

Republicans charge that Obama's message has been negative because his record on the economy is weak. Democrats counter that Romney, who has leveled his share of negative attacks at Obama, has twisted the truth about the president's record and run away from his own.

FINAL PUSH

While Obama starts a tour of swing states including Nevada, Colorado and Ohio, his campaign is focusing intensely on its get-out-the-vote effort, which Democrats believe will give them an edge on Election Day.

Campaign manager Jim Messina, who built the Obama "ground game" of volunteers, said online donations coming in now were going straight to that operation, rather than to television advertising.

"Anything I get online, it goes right out to the ground," Messina said in an interview, contrasting that strategy with Romney's team. "They're still dumping money trying to get a bigger advantage on TV," he said.

His philosophy is evident in the campaign's Chicago-based headquarters. The office, once bustling with hundreds of people, is thinner now as staff members leave to spend the final days of the race working in key states, getting applause from their colleagues as they depart.

Messina said television was less important in the final stretch than having volunteers get voters to the polls.

"The final days, I think TV is way less relevant," Messina said. "We have always banked on the endgame to put us over the top. That's where we are, and we continue to feel very confident that interaction between our neighborhood leaders and their friends and neighbors is how you persuade people at the end."

Exercise Could Improve Your Brain Functioning, Study Suggests

What's good for the body is good for the brain.

Findings presented at the Canadian Cardiovascular Congress show the brain-boosting effects of just four months of exercise.

"It's reassuring to know that you can at least partially prevent that [cognitive] decline by exercising and losing weight," study researcher Dr. Martin Juneau, director of prevention of the Montreal Heart Institute, said in a statement.

The study included overweight and sedentary adults with an average age of 49. They underwent twice-weekly sessions of intense interval training for four weeks -- which included circuit weights and exercise bikes -- before and after which they underwent tests of their cognitive functioning, cardiac output, body composition and exercise tolerance and capacity.

By the end of the study, the researchers found that not only were the participants' body measurements all improved -- they also did better on the tests of cognitive functioning.

"At least 150 minutes of moderate-to-vigorous physical activity per week can make a huge difference to manage risk factors for heart disease and stroke," Dr. Beth Abramson, spokesperson for the Heart and Stroke Foundation, said in a statement. "There are many benefits of exercise -- we know it can make us feel better. This suggests it can make us 'think better' as well."

Recently, a study in the journal Neurology showed that physical exercise trumps mental exercise in beating brain shrinkage (linked with memory problems and even Alzheimer's disease), HuffPost 50 reported.

US manufacturing expands at faster pace in October

WASHINGTON (AP) ? U.S. manufacturing expanded for the second straight month in October, boosted by growth in new orders and production.

The Institute for Supply Management said Thursday that its index of factory activity rose last month to 51.7, up from September's reading of 51.5. A reading above 50 indicates expansion.

The ISM is a trade group of purchasing managers. Previous surveys showed manufacturing contracted from June through August.

The figure is slightly below the average for the year of 52.2. Other reports have suggested that manufacturing is slowing, hampered by less business investment and fewer exports. But the ISM survey points to continued, if gradual, expansion, driven by increased consumer spending.

The report is the final look at U.S. manufacturing conditions before Tuesday's presidential election. The race has been heavily focused on the economy.

Stocks jumped after the release of the October report, along with another report that showed consumer confidence surged last month to the highest level in nearly five years. The Dow Jones industrial average, which had already risen about 70 points after the opening bell, was up 139 points in morning trading.

The survey was completed before Hurricane Sandy disrupted business activity along the East Coast and cut power to millions of homes, an ISM spokesman said.

The details of the report showed that better consumer spending is helping some industries, while weaker business investment is slowing others.

The industries that reported rising new orders are oriented to consumers. Those industries include furniture, food and beverages, paper products and computer and electronics.

The industries reporting falling orders generally depend more on spending by U.S. and overseas businesses. Those industries included machinery, electrical equipment, steel and other metals, and chemical products.

Businesses have grown more cautious for several reasons. Many are nervous about the economic outlook overseas. Europe's financial crisis has pushed much of the region into recession. That has cut into U.S. exports and corporate profits. Growth has also slowed in China, Brazil and other large developing countries.

Companies also fear large tax increases and big government spending cuts that will kick in next year if Congress fails to reach a budget deal to avert them.

Slowing business investment is weighing on economic growth. Company spending on equipment and software was flat this summer, the first quarter it failed to increase since the recession ended more than three years ago.

The economy grew at a 2 percent annual rate in the July-September quarter, up from 1.3 percent in the April-June quarter. Growth increased because of more consumer and government spending, although the rate is still too weak to rapidly spur job creation.
